1. Agreement to Terms

These Terms & Conditions ("Terms") govern your use of services provided by Spa Specials Booking LLC ("Spa Specials," "we," "us," or "our"), including but not limited to appointment booking, deposit processing, and related communications. By booking an appointment, paying a deposit, or otherwise using our services, you agree to these Terms. If you do not agree, please do not use our services.

2. Who We Are

Spa Specials Booking LLC is a booking facilitation and appointment scheduling company that connects consumers with salons, spas, and other beauty and wellness service providers ("Service Providers"). We do not provide salon or spa services directly. We facilitate the booking and process the booking deposit. The actual beauty or wellness services you receive are provided by the independent Service Provider you book with.

3. Booking Deposit

To secure an appointment slot through Spa Specials, you must pay a non-refundable booking deposit of $25.00 USD (the "Deposit") at the time of booking.

3.1 How the Deposit Works

• Deposit collected by: Spa Specials Booking LLC, acting as the merchant of record for the Deposit transaction.
• Purpose of the Deposit: To reserve your appointment time slot with the Service Provider.
• Application of the Deposit: If you attend your appointment, the $25.00 will be credited toward the total cost of your service at the Service Provider, reducing the amount you owe at the salon or spa by $25.00.
• Forfeiture: The Deposit is forfeited (non-refundable) if you cancel, miss, or fail to show up for your appointment, except as set out in Section 5 below.

4. Cancellations & No-Shows

If you cancel your appointment, fail to arrive at your scheduled appointment, or are otherwise unable to attend, your $25.00 Deposit will be retained in full by Spa Specials Booking LLC and is non-refundable. This applies regardless of the reason for the cancellation or no-show, including but not limited to scheduling conflicts, transportation issues, or change of mind.

Cancellations should be made as early as possible by contacting Spa Specials at the details listed in Section 15.

5. Refund Policy

Booking deposits are non-refundable except in the following limited circumstances:

• Service Provider cancellation: If the Service Provider cancels your appointment and is unable to offer you a reasonable alternative time, the $25.00 Deposit will be refunded to your original payment method.
• Duplicate or erroneous charges: If you are charged in error (for example, a duplicate Deposit), we will refund the erroneous charge upon verification.

Refunds, when issued, will be processed to your original payment method within a commercially reasonable timeframe (typically 5–10 business days, depending on your bank or card issuer).

To request a refund under this Section, contact us using the details in Section 15.

6. Rescheduling Policy

You may reschedule your appointment one (1) time at no additional cost, provided that:

• You provide at least 24 hours' notice before your scheduled appointment time, AND
• The reschedule is to a date and time that the Service Provider can accommodate.

If you reschedule with less than 24 hours' notice, fail to provide notice, or attempt to reschedule more than once, the Deposit may be forfeited and a new Deposit may be required to book a future appointment, at our discretion.

Reschedule requests should be made by contacting Spa Specials using the details in Section 15.

7. Service Provider Relationship

Spa Specials Booking LLC is a separate and independent entity from the salons, spas, and Service Providers featured on our platform. We are not the provider of the beauty or wellness services and we do not employ the Service Providers' staff. Each Service Provider is an independent business responsible for the services it provides.

You acknowledge and agree that:

• Spa Specials does not warrant or guarantee the quality, suitability, or outcome of services provided by Service Providers.
• Any claim, dispute, or complaint relating to the services performed at a salon or spa must be addressed directly with that Service Provider.
• Pricing for services beyond the $25.00 Deposit is set by, and paid directly to, the Service Provider.

8. Payment Authorization

By submitting payment information at the time of booking, you authorize Spa Specials Booking LLC to charge $25.00 USD to the payment method you provide. You confirm that you are the authorized holder of the payment method or have permission from the authorized holder to use it. You acknowledge that the charge will appear on your statement as originating from Spa Specials Booking LLC.

9. User Conduct

You agree not to:

• Provide false, inaccurate, or misleading information when booking.
• Use our services for any unlawful purpose or in violation of any applicable law.
• Attempt to disrupt, damage, or interfere with our services, systems, or networks.
• Submit fraudulent chargebacks or payment disputes.
• Harass, abuse, or threaten our staff or any Service Provider's staff.

We reserve the right to refuse service, cancel bookings, or terminate access for any user who violates these Terms.

10. Intellectual Property

All content on the Spa Specials website and platform — including the Spa Specials name, logo, designs, text, graphics, and software — is the property of Spa Specials Booking LLC or its licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written permission.

11. Disclaimers

Our services are provided on an "as-is" and "as-available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will be uninterrupted, error-free, or free of viruses or other harmful components.

12. Limitation of Liability

To the fullest extent permitted by law, Spa Specials Booking LLC, its officers, members, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or in connection with your use of our services. Our total aggregate liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the amount of the Deposit ($25.00 USD) you paid for the booking giving rise to the claim.

13. Governing Law

These Terms and any dispute arising out of or relating to them, your use of our services, or the Deposit transaction shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of laws principles. You agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in Berkeley County, South Carolina, and you consent to the jurisdiction and venue of such courts.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of our services after we post changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

Privacy Policy

1. Overview

Spa Specials Booking LLC ("Spa Specials," "we," "us," or "our") respects your privacy. This Privacy Policy explains what personal information we collect, how we use it, when and how we communicate with you (including by phone and text), your opt-out rights, and how we comply with the Telephone Consumer Protection Act ("TCPA") and CAN-SPAM Act.

By using our services or providing your information to us, you agree to the collection and use of information in accordance with this Policy.

2. Information We Collect

We collect information that you provide directly to us during the booking process and our communications with you, including:

• Contact information: Your full name, mobile phone number, email address, and (where relevant) mailing address.
• Booking information: The salon or spa you are booking with, the service requested, the appointment date and time, and any preferences or notes you share.
• Payment information: Information needed to process the $25.00 booking deposit, such as your card details. Payment card details are processed by our PCI-compliant payment processor and are not stored on our own servers.
• Communication content: Messages you exchange with our team or our automated booking assistant during the booking process.
• Technical information: Device, browser, IP address, and limited analytics data, collected automatically when you visit our website or interact with our digital communications.

3. How We Use Your Information

We use your personal information to:

• Schedule, confirm, and manage your appointment with the Service Provider.
• Process your $25.00 booking deposit.
• Send appointment confirmations, reminders, follow-ups, and other transactional communications by phone, text message (SMS), or email.
• Communicate with you about questions, reschedule requests, cancellations, or related service issues.
• Send you marketing or promotional messages about offers from Spa Specials and our partner Service Providers, where you have consented to receive them and where permitted by law.
• Improve and operate our services and prevent fraud or abuse.
• Comply with legal obligations.

4. Phone, Text & Email Communications

By providing your phone number and contact information during the booking process, you understand that Spa Specials and our authorized representatives (including our automated booking assistant and live team members) may contact you by phone call, text message (SMS), and email for purposes including, but not limited to:

• Confirming your appointment details.
• Sending appointment reminders.
• Following up after your appointment.
• Asking clarifying questions about your booking.
• Notifying you of changes, cancellations, or rescheduling needs.
• Sending promotional offers and updates, where you have consented to receive them.

Standard message and data rates may apply to text messages, depending on your mobile carrier and plan.

5. TCPA Consent & Compliance

Spa Specials Booking LLC is committed to compliance with the Telephone Consumer Protection Act ("TCPA"), 47 U.S.C. § 227, and related Federal Communications Commission ("FCC") rules. In keeping with TCPA requirements:

• We obtain consent before sending automated marketing calls or texts.
• We honor opt-out requests promptly. You can opt out of text messages at any time by replying STOP to any text message from us, or by contacting us using the details in Section 15.
• We maintain internal procedures to identify and respect Do-Not-Call requests.
• We do not place automated marketing calls during prohibited hours under federal or applicable state law.
• We identify ourselves clearly in calls and text messages we send.

6. CAN-SPAM Compliance

Spa Specials Booking LLC complies with the CAN-SPAM Act of 2003 for all commercial email communications. This means:

• We do not use false or misleading header information or subject lines.
• We identify commercial messages as advertisements where required.
• We include our valid physical postal address in marketing emails.
• We provide a clear and visible unsubscribe link in every marketing email.
• We honor opt-out requests within 10 business days, and typically much sooner.

7. Your Opt-Out Rights

You have the right to opt out of marketing communications from us at any time. Specifically:

• Text messages (SMS): Reply STOP to any text message from us to stop further marketing texts. Reply HELP for assistance.
• Marketing emails: Click the "unsubscribe" link in any marketing email, or contact us using the details in Section 15.
• Phone calls: Tell the caller that you wish to be added to our internal Do-Not-Call list, or contact us using the details in Section 15.

Please note: even after opting out of marketing communications, we may still need to send you transactional or service-related messages — such as appointment confirmations, reminders, payment receipts, and important changes — that are necessary to facilitate your booking.

8. Information Sharing

We do not sell your personal information to third parties.

We share your personal information only as necessary to provide our services, including with:

• The Service Provider you have booked with — to confirm your appointment, share your contact information, and let them prepare for your visit.
• Service vendors who help us operate (for example, our payment processor, SMS/email provider, and hosting provider) — these vendors are bound by contractual obligations to handle your information confidentially.
• Legal authorities — when required by law, subpoena, or court order, or to protect our legal rights or the safety of others.
• In a business transfer — if Spa Specials Booking LLC is acquired by or merged with another company, your information may be transferred subject to standard confidentiality protections.

9. Data Security

We use commercially reasonable physical, administrative, and technical safeguards to protect your personal information from unauthorized access, alteration, disclosure, or destruction. However, no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.

10. Cookies & Tracking

Our website may use cookies and similar tracking technologies to remember your preferences, measure how our website is used, and improve your experience. You can control cookies through your browser settings. We may also use third-party analytics tools (such as Google Analytics) to help us understand site usage; these tools collect limited information subject to their own privacy policies.
